Terms and conditions of carriage
Please read these terms carefully before booking. By making a booking you agree to be bound by them.
These Terms and Conditions (“Terms”) govern every booking made with Sea & Sky Luxury Transfers Ltd. (“the Company”, “we”, “us”, “our”), a private hire vehicle operator licensed to provide pre-booked chauffeur and executive transfer services. By making a booking, whether online, by telephone, by email, or through a third-party agent, the customer (“you”, “the passenger”, “the client”) agrees to be bound by these Terms.
If you do not agree with any part of them, please do not proceed with a booking and contact us to discuss your requirements.
1. About us and licensing
Sea & Sky Luxury Transfers Ltd. is a private hire vehicle operator, licensed and operating in accordance with the private hire vehicle licensing requirements of Dorset Council, the local licensing authority in which it is based.
All vehicles, drivers, and the operator itself are appropriately licensed, insured for private hire and hire and reward purposes, and subject to routine safety inspection mandated under UK law and in accordance with Dorset Council policies.
We are not a licensed hackney carriage (street-hail taxi) operator. All journeys must be pre-booked; we do not accept bookings hailed on the street.
2. Definitions
- Booking means a confirmed reservation for a transfer service, whether a single journey or a series of journeys.
- Confirmation means the written (email, SMS, or app) confirmation issued by us following a booking request.
- Journey means transport of the passenger(s) and agreed luggage from a specified pick-up point to a specified drop-off point.
- Flight/Sailing Monitoring means our practice of tracking scheduled arrival times using publicly available flight or cruise schedule data.
- Force Majeure Event has the meaning given in Clause 12.
3. Bookings and confirmation
A booking is only guaranteed once you have received written confirmation from us, including your pick-up details, vehicle type, and quoted fare. Verbal quotations or requests are not binding until confirmed.
Information you must provide
- Accurate pick-up and drop-off addresses, dates and times.
- Flight number and departure airport, or ship name, cruise line and port of embarkation or disembarkation, where relevant.
- Number of passengers and items of luggage, including any oversized items such as golf clubs, wheelchairs, prams and sports equipment.
- Any special requirements, such as a child car seat, wheelchair-accessible vehicle, or additional stops.
We reserve the right to decline or amend a booking where the vehicle requested is unsuitable for the number of passengers or volume of luggage declared, or where information provided is incomplete or inaccurate. Additional charges may apply if the actual number of passengers, luggage, or stops exceeds what was declared at booking.
4. Pricing and payment
- All fares are quoted in advance and are fixed at the time of confirmation, save for any variations expressly permitted under these Terms, for example additional waiting time, extra stops, or extra luggage and passengers not declared at booking.
- Quoted fares include standard waiting time as set out in Clause 7, tolls and standard car parking known at the time of quotation. Airport and port drop-off charges, congestion charges, or unforeseen toll changes may be added where applicable and will be notified where possible.
- Payment may be taken at the time of booking, on completion of the journey, or by invoice for approved account customers, as agreed at the time of booking.
- We accept payment by the methods stated on our booking platform or as agreed directly with our office. Gratuities are at your discretion and are never compulsory.
- Prices are reviewed periodically; the price confirmed to you at booking is the price payable for that journey, regardless of subsequent changes to our general pricing.
5. Cancellations, amendments and no-shows
Cancellations by you
- Cancellations made more than 24 hours before the scheduled pick-up time will receive a full refund of any deposit or pre-payment.
- Cancellations made between 24 hours and 4 hours before pick-up may incur a cancellation charge of up to 50% of the fare.
- Cancellations made less than 4 hours before pick-up, or failure to cancel, may incur the full fare.
Amendments
We will always try to accommodate amendments to pick-up time, location, or vehicle type, subject to availability. Amendments may result in a revised fare.
No-shows
If our driver attends the agreed pick-up point at the agreed time, allowing for the waiting time in Clause 7, and the passenger cannot be located or does not attend, and we are unable to make contact using the details provided, the journey will be treated as a no-show and the full fare will remain payable.
6. Flight and cruise monitoring, delays
- For airport and cruise terminal transfers, we monitor scheduled arrival times using publicly available flight or sailing data where a flight number or vessel name has been provided at booking.
- Where a flight or sailing is delayed, we will make reasonable efforts to adjust the pick-up time accordingly at no extra charge, subject to driver availability.
- Flight and sailing monitoring is provided as a courtesy and is dependent on third-party data. We cannot guarantee its accuracy and are not liable for delays or errors in the data provided by airlines, airports, cruise lines, or ports.
- Significant delays, for example overnight delays or diversions, should be reported to us as soon as possible so that we can rearrange the transfer; this may be treated as an amendment under Clause 5.
7. Waiting time
- Airport and cruise terminal pick-ups: 60 minutes’ free waiting time from the confirmed landing or docking time, to allow for disembarkation, immigration, baggage reclaim and customs.
- All other pick-ups: 15 minutes’ free waiting time from the confirmed pick-up time.
- Waiting time beyond these allowances is charged at our standard hourly waiting rate, notified to you at booking or available on request, and will be added to the final fare.
If you anticipate a delay, please contact us as early as possible so that we can plan the driver’s schedule accordingly.
8. Luggage and belongings
- Standard luggage allowances are based on the vehicle type booked. Please advise us of oversized, unusual, or additional items at the time of booking so that an appropriately sized vehicle can be provided.
- Drivers will take reasonable care when handling luggage, but the Company’s liability for loss of or damage to luggage is limited as set out in Clause 11.
- Passengers are responsible for checking that they have removed all personal belongings from the vehicle at the end of the journey. We will make reasonable efforts to return any items found or to hand them to the police for safe-keeping, but cannot guarantee recovery and may charge a reasonable fee to cover the cost of returning items.
9. Passenger conduct and use of the vehicle
- Passengers must treat drivers and vehicles with respect. Abusive, threatening, or violent behaviour towards a driver will result in the immediate termination of the journey without refund, and may be reported to the police.
- Smoking, vaping, and the consumption of alcohol or any illegal substances are not permitted in any vehicle.
- The driver may refuse to carry, or may terminate the journey of, any passenger who appears to be, in the driver’s reasonable judgement, a risk to the safety of themselves, other passengers, or the driver, including through intoxication or disorderly conduct. No refund will be given in such circumstances.
- Seatbelts must be worn at all times where fitted, in accordance with the law.
- Any damage caused to a vehicle by a passenger, whether through negligence, recklessness, illness, or deliberate act, including soiling requiring professional cleaning, will be charged to the passenger at the reasonable cost of repair or cleaning.
10. Children and car seats
If your journey requires a child car seat or booster seat, you are responsible for the supply of a suitable seat for the child. Where a child seat requirement has not been notified, we reserve the right to decline the journey or to source a suitable seat, which may incur a delay and an additional charge.
11. Liability and insurance
- All our vehicles carry hire-and-reward insurance covering passengers as required by law.
- Our liability for loss, damage, or delay is limited to that required by applicable law and our insurance cover. We do not accept liability for indirect or consequential loss, such as missed flights, missed sailings, or missed connections, except where such loss arises from our own negligence or that of our driver.
- Passengers travel at their own risk in respect of personal property. We strongly recommend that valuable items are kept with the passenger rather than stored in luggage compartments, and that passengers hold appropriate travel insurance covering missed departures.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud, or any other liability that cannot lawfully be excluded or limited.
12. Force majeure
We will not be liable for any failure or delay in performing our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to severe weather, road closures, traffic accidents, strikes, civil unrest, acts of terrorism, pandemic-related restrictions, or mechanical failure that could not reasonably have been foreseen (a “Force Majeure Event”). Where a Force Majeure Event affects a booking, we will make reasonable efforts to notify you and to provide an alternative solution where possible.
13. Complaints and customer service
We aim to provide a punctual, safe, and professional service at all times. If you are dissatisfied with any aspect of your journey, please contact us as soon as possible, and in any event within 14 days of the journey, so that we can investigate promptly. We will acknowledge complaints within 2 working days and aim to provide a full response within 14 days.
14. Data protection and privacy
We process personal data, such as your name, contact details, flight or sailing information, and pick-up and drop-off addresses, in order to provide and manage your booking, in accordance with applicable data protection law, including the UK General Data Protection Regulation. We do not sell personal data to third parties. Full details of how we collect, use, and protect your information are set out in our Privacy Policy.
15. Changes to these terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The version of the Terms in force at the time you make a booking will apply to that booking. The current version will always be available on our website or on request.
16. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the law of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
